GULL COTTAGE RULES AND RESPONSIBILITIES

 

RENTER. The Renter is the person who pays for the use of Gull Cottage during the rental period and is the one who is responsible for ensuring the RULES AND RESPONSIBILITIES of this agreement are complied with.

 

RENTERS OVERALL RESPONSIBILITY The Renter has the overall responsible for ensuring that the people and pets using the cottage during the Renters Rental Period do so according to the rules below and according to the pet agreement if pets are brought on to the property.

 

SCOPE OF RESPONSIBILITY The Renter is responsible for the cottage and the cottage property including interior and exterior furnishings and equipment, the grounds, boats, and other items provided to the Renters Party and Guests.

 

PERIOD OF RESPONSIBILITY The Renter has the responsibility for cottage and cottage property during the rental period, and until the keys have been returned.

 

PROPERTY INSPECTION The renter must inspect the property immediately upon arrival, the purpose being to fully observe the nature, risks and limitations of the property (including the fencing. Regarding the fencing, kids and pets can find their way in and out of the fencing, please be sure you know where your kids and pets are at all times) Any dangerous conditions noticed should be brought to the attention of the owner immediately.

 

WATERFRONT PROPERTY AND GENERAL SAFETY REQUIREMENTS There is the obvious potential for injury and death/drowning caused by use of the property and its proximity to water. Kids must be under control at all times, there is a street with limited traffic visibility in the back, and deep water in front of property (when tide is in). No standing on or diving from the bulkhead. The renter must take responsibility for ensuring that their use (and use by their party and guests) of the property and the items supplied with the property is done in a safe and legal manner, and to inform their guests of any condition that may be unsafe.

 

NO SMOKING. No smoking within the cottage

 

NO DANGEROUS OR ILLEGAL MATERIALS OR ACTIVITIES ALLOWED ON THE PREMISE.

 

FIRE OR OTHER CONDITIONS MAKING THE PREMISE UNSUITABLE FOR OCCUPANCY. Any cause making the premise unsuitable for occupancy shall result (and be limited to) any unused portion of rental charges being returned to the Renter, providing such conditions are not the result of the Renter, their party, or their guests’ miss-use of the property.

 

INDEMNIFY AND HOLD HARMLESS. The Renter, the Renters Party and Guests shall hereby indemnify and hold harmless the owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss.
